When you RSVP you herby consent & acknowledge all of the following..
THE FOOTBALL BOUTIQUE PARTICIPATION WAIVER, RELEASE OF LIABILITY & MEDIA CONSENT:
In consideration for being permitted to participate in any event, tournament, activation, clinic, competition, exhibition, or related activities (collectively, the “Event”) hosted, organized, operated, or facilitated by The Football Boutique, LLC, and/or involving Nike, its affiliates, representatives, contractors, sponsors, partners, and agents, the undersigned acknowledges and agrees as follows:
1. ASSUMPTION OF RISK
I understand that participation in soccer-related activities, competitions, athletic drills, gameplay, training, and related event activities involves inherent risks, including but not limited to:
slips, trips, and falls
collisions with players, staff, spectators, equipment, or structures
muscle strains, sprains, fractures, concussions, or other bodily injury
property loss or damage
risks associated with crowds, event equipment, and venue conditions
I knowingly and voluntarily assume all risks, known or unknown, associated with participation in the Event.
2. RELEASE OF LIABILITY
To the fullest extent permitted by law, I, on behalf of myself and, if applicable, my minor child, heirs, assigns, personal representatives, and next of kin, hereby release, waive, discharge, and covenant not to sue:
The Football Boutique, LLC
Nike, Inc., its affiliates, subsidiaries, employees, contractors, sponsors, agents, and representatives
any event partners, vendors, volunteers, staff, landlords, property owners, and affiliated personnel connected with the Event
from any and all liability, claims, demands, causes of action, damages, losses, costs, or expenses of any kind arising out of or related to participation in the Event, including personal injury, illness, death, or property damage, whether caused by ordinary negligence or otherwise, except to the extent caused by gross negligence or willful misconduct where such release is prohibited by applicable law.
3. MEDICAL FITNESS
I certify that I (or my minor child) am physically fit and sufficiently prepared to participate in the Event. I understand that The Football Boutique and Nike are not responsible for determining participant medical fitness.
I authorize event staff to seek emergency medical treatment if necessary, and I understand that I am solely responsible for any medical costs incurred.
4. PERSONAL PROPERTY
I understand that The Football Boutique and Nike are not responsible for lost, stolen, or damaged personal property brought to or used during the Event.
5. MEDIA RELEASE / PHOTO & VIDEO CONSENT
I understand that the Event may be photographed, filmed, livestreamed, or otherwise recorded. I hereby grant The Football Boutique, LLC, Nike, and their respective affiliates, partners, licensees, and designees the irrevocable right and permission to capture, use, reproduce, edit, publish, distribute, display, and otherwise exploit my (or my minor child’s) name, image, likeness, voice, social handle, and appearance in any photographs, video, digital content, social media, promotional materials, marketing materials, recaps, websites, and other media now known or later developed, worldwide, in perpetuity, without additional approval or compensation.
6. CODE OF CONDUCT
I agree to act respectfully and safely at all times. I understand that event staff may remove any participant or attendee for unsafe, disruptive, abusive, or inappropriate conduct, without refund or compensation, if applicable.
7. MINOR PARTICIPANTS
If the participant is under 18 years of age, this waiver must be signed by a parent or legal guardian. By signing below, the parent/legal guardian agrees to all terms on behalf of the minor participant and consents to the minor’s participation.
8. GOVERNING LAW
This agreement shall be governed by and construed in accordance with the laws of the State of California.
9. ACKNOWLEDGEMENT
I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS BY SIGNING IT. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY.LIABILITY WAIVER, RELEASE & MEDIA CONSENT
