In partnership with the Healthcare Club of NY and Caseflow AI (usecaseflow.ai) for NY TECH WEEK. New York is about to decide something the rest of the country will be watching: whether chatbot companies should be on the hook when their AI gives medical, legal, or mental health advice that causes harm. Senate Bill S7263, sponsored by State Senator Kristen Gonzalez, would make chatbot operators civilly liable when their AI provides "substantive" advice in domains covered by professional licensing law. That's 14+ licensed professions plus the practice of law. Disclaimers don't save you. A "you're talking to a bot" notice doesn't save you. And the private right of action means anyone harmed can sue. Supporters say it's common sense: if a human pretending to be a doctor can be prosecuted, a chatbot that hallucinates a medical license shouldn't get a free pass. Critics say the bill is vague about what counts as "substantive" advice, puts nonprofit and government chatbots in the same legal crosshairs as OpenAI, and ends up taxing the people who most need low-cost information (tenants, patients, small business owners) on behalf of licensed incumbents who don't love the competition. Both sides have a point. That's why we're putting them in a room.
